The United States is stepping up its efforts to combat circumvention of its antidumping, countervailing duty, and general customs laws, and all indications point to even more vigorous enforcement in the future. Over the past few years, U.S. Customs and Border Protection agents seized many millions of dollars in fraudulently entered goods, levied many millions of dollars in fines, and arrested numerous U.S. importers involved in fraud and circumvention schemes.

Engaging in fraud and circumvention exposes companies to the risk of seizures of shipments, imprisonment of U.S.-based associates, monetary penalties, and being banned from exporting to the United States altogether.

To avoid such consequences, companies trading in goods subject to antidumping or countervailing duty orders should lawfully participate in proceedings run by the U.S. Department of Commerce and U.S. International Trade Commission. In obtaining a company-specific or separate duty rate through such proceedings, companies may secure their access to the U.S. market, in full compliance with U.S. fair trade law.

If you trade in goods subject to U.S. antidumping or countervailing duty orders, our office may assist you by:

1-Preparing and submitting a "separate rate" application, by which you may obtain your own individual duty rate, separate from the punitive "country-wide" rate.

2-Filing a "scope clarification request," by which your product may be excluded from the parameters of an antidumping or countervailing duty order.

3-Representing your interests before the U.S. Department of Commerce and U.S. International Trade Commission in a full antidumping or countervailing duty investigation or review proceeding.
